Recriminación
En la ley, la recriminación es una defensa en una acción de divorcio en la que la parte acusada hace una acusación similar contra el demandante. En inglés, es una manera de decir de un abogado, "Tú también". La recriminación fue generalmente considerada por los expertos en derecho de familia como uno de los aspectos más disfuncionales e ilógicos del antiguo sistema de divorcio basado en la culpa en los países de derecho consuetudinario. Por ejemplo, en el contexto de un matrimonio donde la relación matrimonial se ha colapsado hasta el punto de que ambos esposos están cometiendo abiertamente adulterio, la afirmación por parte de cualquiera de los cónyuges de esta defensa impediría el divorcio aunque la unidad familiar claramente ya no es capaz de funcionar . Como resultado, la defensa fue formalmente abolida por la ley en muchas jurisdicciones cuando se convirtieron a un régimen de divorcio sin culpa.
