La jurisprudence est l'étude et la théorie du droit. Les chercheurs en jurisprudence, également connus sous le nom de théoriciens juridiques, espèrent obtenir une compréhension plus approfondie de la nature du droit, du raisonnement juridique, des systèmes juridiques et des institutions juridiques. La jurisprudence moderne a commencé au 18ème siècle et a été axée sur les premiers principes de la loi naturelle, du droit civil et du droit des nations. La jurisprudence générale peut être divisée en catégories à la fois par le type de questions que les chercheurs cherchent à répondre et par les théories de la jurisprudence ou des écoles de pensée concernant la meilleure réponse de ces questions. La philosophie contemporaine du droit, qui traite de la jurisprudence générale, traite des problèmes dans deux groupes difficiles: ▪ Problèmes internes au droit et aux systèmes juridiques en tant que tels. ▪ Les problèmes du droit en tant qu'institution sociale particulière en ce qui concerne la situation politique et sociale dans laquelle il existe. Les réponses à ces questions proviennent de quatre écoles primaires de pensée dans la jurisprudence générale: ▪ Le droit naturel est l'idée qu'il existe des limites objectives rationnelles au pouvoir des dirigeants législatifs.
