Distintività del marchio
Il distintivo del marchio è un concetto importante nella legge che disciplina marchi e marchi di servizio. Un marchio può essere eleggibile per la registrazione, o registrabile, se svolge la funzione di marchio essenziale e ha carattere distintivo. La registrazione può essere intesa come un continuum, con marchi "intrinsecamente distintivi" ad una estremità, contrassegni "generici" e "descrittivi" senza carattere distintivo all'altra estremità e contrassegni "suggestivi" e "arbitrari" situati tra questi due punti. I marchi "descrittivi" devono acquisire la distinzione attraverso il significato secondario - i consumatori sono venuti a riconoscere il marchio come indicatore di origine - essere protetti. I termini "Generici" vengono utilizzati per fare riferimento al prodotto o al servizio stesso e non possono essere utilizzati come marchi commerciali.
