Il sistema giudiziario è il sistema dei tribunali che interpreta e applica la legge in nome dello stato. Il giudice fornisce anche un meccanismo per la risoluzione delle controversie. Sotto la dottrina della separazione dei poteri, il sistema giudiziario in genere non rende legge né applica la legge, ma interpreta la legge e lo applica ai fatti di ogni caso. I tribunali con il potere di revisione giudiziaria possono annullare le leggi e le regole dello Stato quando li trova incompatibili con una norma più elevata, come la legislazione primaria, le disposizioni della costituzione o del diritto internazionale. I giudici costituiscono una forza critica per l'interpretazione e l'attuazione di una costituzione, dunque in realtà i paesi di diritto comune creano il corpo di diritto costituzionale.
