Recriminazione
In diritto, la recriminazione è una difesa in un'azione di divorzio in cui la parte accusata fa una simile accusa contro l'attore. In inglese, è un modo di dire di un avvocato: "Anche voi". La recriminazione è stata generalmente considerata dagli esperti di diritto di famiglia come uno degli aspetti più disfunzionali e illogici del vecchio sistema di divorzio basato su colpa nei Paesi di diritto comune. Ad esempio, nel contesto di un matrimonio in cui il rapporto coniugale si è crollato fino a che entrambi i coniugi siano apertamente adulterio, l'affermazione di entrambi i coniugi di questa difesa impedirebbe un divorzio anche se l'unità familiare non è più in grado di funzionare . Di conseguenza, la difesa è stata formalmente abolita da statuto in molte giurisdizioni quando si sono convertiti in un regime di divorzio senza fallo.
