Uma atribuição é um termo usado com significados semelhantes na lei dos contratos e na lei do imobiliário. Em ambos os casos, abrange a transferência de direitos detida por uma das partes - o cedente - para outra parte - o cessionário. Os detalhes da atribuição determinam alguns direitos e responsabilidades adicionais. Normalmente, um terceiro está envolvido em um contrato com o cedente, e o contrato é efetivamente transferido para o cessionário. Por exemplo, um mutuário empresta dinheiro de um banco local. O banco local recebe uma nota de hipoteca e, posteriormente, pode transferir essa nota para uma instituição financeira em troca de um montante fixo de caixa, atribuindo assim o direito de receber o pagamento do mutuário para outra entidade. As hipotecas e os contratos de empréstimos são relativamente sujeitos à atribuição, uma vez que as obrigações do empresário são relativamente limitadas; outros contratos que envolvam deveres pessoais, como advogados legais, podem não ser atribuíveis. O conceito relacionado de novação não é atribuição; em vez de atribuir apenas os direitos a outra parte, a novação envolve a substituição da parte original por uma nova parte ou a substituição do contrato original por um novo contrato.
