O direito internacional é o conjunto de regras geralmente consideradas e aceitas como vinculativas nas relações entre estados e entre países. Ele serve de quadro para a prática de relações internacionais estáveis e organizadas. O direito internacional difere dos sistemas jurídicos baseados no estado em que é principalmente aplicável aos países e não aos cidadãos particulares. A lei nacional pode tornar-se lei internacional quando os tratados delegam jurisdição nacional em tribunais supranacionais, como o Tribunal Europeu de Direitos Humanos ou o Tribunal Penal Internacional. Tratados como as Convenções de Genebra podem exigir que a legislação nacional se conforme. Grande parte do direito internacional é a governança baseada em consentimento. Isto significa que um membro estadual da comunidade internacional não é obrigado a respeitar este tipo de direito internacional, a menos que tenha expressamente consentido em um determinado curso de conduta. Esta é uma questão de soberania do Estado. No entanto, outros aspectos do direito internacional não são baseados no consentimento, mas ainda são obrigatórios para os atores estatais e não estatais, como o direito internacional consuetudinário e as normas peremptórias.
