Casamento putativo
Um casamento putativo é um casamento aparentemente válido, celebrado de boa fé por pelo menos um dos parceiros, mas isso é juridicamente inválido devido a um impedimento técnico, como um casamento preexistente por parte de um dos sócios. Ao contrário de alguém em casamento comum, legal ou cerimonial, um cônjuge putativo não é legalmente casado. Em vez disso, uma esposa putativa se considera casada de boa fé e recebe direitos legais como resultado da confiança desta pessoa nesta crença de boa-fé. Casamentos putativos existem tanto no direito cânon católico quanto em várias leis civis, embora as regras possam variar. Em algumas jurisdições, os casamentos putativos são uma questão de jurisprudência e não legislação. Em muitas jurisdições, de acordo com a lei civil, o casamento se torna válido se o impedimento for removido. Se não for removido, o cônjuge inocente, pelo menos, muitas vezes tem direito à proteção de um divórcio para a divisão de bens e custódia da criança.
