Yasallık ilkesi
Yasal olma ilkesi, tüm yasaların açık, tespit edilebilir ve retrospektif olmamasını gerektiren yasal idealdir. Karar vericilerinin, önceden bildirilen yasal kuralları uygulayarak ve mevcut durumu belirlenmiş kanunlardan ayrılmak suretiyle hukuki durumu geriye dönük olarak değiştirmemesi yoluyla anlaşmazlıkları çözmesini gerektirir. Yasal biçimcilik ve hukukun üstünlüğü ile yakından ilgilidir ve Feuerbach, Dicey ve Montesquieu'nun yazılarından izlenebilir. İlke ceza ve idare hukukunda özellikle önemlidir. Cezai hukukta, komisyon veya ihmal sırasında suç teşkil etmeyen eylem veya ihmaller için cezai yaptırımların uygulanmasına ilişkin genel yasakta görülebilir. Belirli bir suç için yaptırımlar geriye dönük olarak arttıkça ilkenin de ihlal edildiği düşünülür. İdari hukukta, devlet görevlilerinin, hevesle hareket etmek yerine yasayla bağlı oldukları ve uygulayacağı arzusunda görülebilir. Bu prensip savunucuları normal olarak takdir yetkilerine karşıdır.
