Makul kişi, yasayı jüride açıklayan birçok araçtan biridir. "Makul kişi", ortaya çıkan ortak hukuk kavramıdır. Siyah harf yasasında fikir birliğine varıldığı halde, evrensel olarak kabul gören ve teknik bir tanım yoktur. Bir yasal kurgu olarak "makul kişi", ortalama bir kişi ya da tipik bir kişi değildir. Bunun yerine, "makul kişi", topluluğun tipik bir üyesinin halka zarar tehdidi oluşturabilecek durumlarda nasıl davranması gerektiği konusundaki ilgili topluluğun kararının bir bileşimidir.
