Eine Gebotsanleihe wird im Rahmen eines Angebotsgebots durch den Auftragnehmer an den Projektinhaber ausgegeben, um in der Hoffnung zu garantieren, dass der Sieger Bieter den Vertrag unter den Bedingungen, unter denen sie bieten, übernimmt. Die Kaution unterliegt einem vollständigen oder teilweisen Verzug, wenn der Gewinner Vertragspartner den Vertrag nicht ausführt oder die erforderlichen Leistungs- und / oder Zahlungsschuldverschreibungen vorsieht. Die Gebotsanleihe sichert und garantiert, dass der Bieter, wenn der Bieter erfolgreich sein wird, den Vertrag ausführt und die erforderlichen Bürgschaften anbietet. Eine Gebotsanleihe in Höhe von höchstens 10% des Auftragsauftragsbetrags wird hinterlegt, wenn ein Auftragnehmer oder der "Lieferant" einen Ausschreibungsvertrag abgibt. Die Bid Bond prüft den Auftraggeber vor und stellt dem Eigentümer oder Generalunternehmer die notwendige Sicherheit zur Verfügung, oder "verpflichten" und garantiert, dass der Auftraggeber den Vertrag abschließen wird, wenn er vergeben wird. Eine Gebotsanleihe garantiert, dass die "Verpflichtung" die Differenz zwischen dem Ausschreibungspreis des Auftraggebers und dem nächstgelegenen Angebotspreis bezahlt wird. Diese Klage wird nur ausgelöst, wenn der Auftraggeber den Auftrag vergeben hat, aber nicht mit dem Pflichten den Vertrag abschließen kann.
