Clawback
Eine Klausel- oder Klauselvorschrift ist eine besondere Vertragsklausel, die typischerweise in den Arbeitsverträgen von Finanzunternehmen enthalten ist. Das Ziel der Klausel ist es, eine Option für einen Arbeitgeber zu sichern, um die Boni im Falle von katastrophalen Verschiebungen in der Wirtschaft, wie die Finanzkrise von 2007-2010 zu begrenzen. Der Begriff Clawbacks oder Klauenrücken kann auch verwendet werden, um auf Geld oder Leistungen zu verweisen, die ausgegeben wurden, aber aufgrund besonderer Umstände, die in einem Vertrag erwähnt werden, zurückgegeben werden müssen. Die Anleiheprämien sind in einem Clawback-Schema speziell an die Leistung des Finanzprodukts gebunden, das der Einzelne im Rahmen seiner Arbeit mit einem hohen Gewinn erworben und / oder verkauft hat. Wenn das Produkt tatsächlich über einen längeren Zeitraum gut läuft und die Art des Unternehmens dauerhaft verbessert, können die an den Einzelnen gezahlten Prämien vom Einzelnen behalten werden. Sollte das Produkt jedoch fehlschlagen und die Art der festen, gleichmäßigen Jahre nach der Inbetriebnahme des Produkts beschädigen, so hat die Firma das Recht, den Bonusbetrag zu widerrufen, zurückzugewähren oder anderweitig zurückzunehmen.
