Solicitor

In English, solicitor refers to a type of attorney from the common law system who practices postulating, counseling, drafting private and procedural documents, property negotiation, and any other extrajudicial functions. He is a generalist lawyer and an adjunct to justice in countries with a tradition of English law, including the United Kingdom, Hong Kong, Ireland, Australia and New Zealand, India, formerly in Canada, but absent from the States -United. In most common law states, the solicitor is divided between the solicitor who represents and advises his clients, and applies on their behalf, and the barrister who, through the solicitor, attends the courts, has a monopoly of the pleadings and renders opinions and consultations. The solicitor thus resembles in many ways the attorney and shares with him his functions during the representation ad litem. On the other hand, it is the lawyer and the former legal counsel that the solicitor resembles on an out-of-court basis. En anglais, solicitor désigne un type d'avocat du système de droit de la common law qui pratique la postulation, le conseil, la rédaction d'actes sous seing privé et pièces de procédure, la négociation immobilière, et toute autre fonction extrajudiciaire. Il est juriste généraliste et auxiliaire de justice des pays de tradition de droit anglais, dont le Royaume-Uni, Hong Kong, l'Irlande, l'Australie et la Nouvelle-Zélande, l'Inde, anciennement au Canada, mais absent aux États-Unis. Dans la plupart des États de common law, l'avocature est divisée entre le solicitor qui représente et conseille ses clients, et postule pour leur compte, et le barrister qui, par l'intermédiaire du solicitor, assiste devant les cours, a le monopole de la plaidoirie et rend des avis et consultations. Le solicitor ressemble ainsi sur beaucoup de points à l'avoué et partage avec celui-ci ses fonctions lors de la représentation ad litem. En revanche, c'est à l'avocat et à l'ancien conseil juridique que le solicitor ressemble sur le plan extrajudiciaire.
