Hipotecación

La hipoteca es la práctica en la que un prestatario promete una garantía para asegurar una deuda o un prestatario, como condición previa a un préstamo, o tiene una garantía de prenda de un tercero para el prestatario. El prestatario conserva la propiedad de la garantía, pero el acreedor tiene el derecho de tomar posesión si el prestatario incumple. Un ejemplo común ocurre cuando un consumidor entra en un acuerdo de hipoteca, en el cual la casa del consumidor se convierte en garantía hasta que el préstamo hipotecario se paga. La práctica detallada y las reglas que regulan la hipoteca varían dependiendo del contexto y de la jurisdicción donde se produce. En los Estados Unidos, el derecho legal para que el acreedor tome posesión de la garantía si el deudor incumple se clasifica como un gravamen. La rehypothecation es una práctica profesional de los mercados financieros, en la que la contraparte reutiliza una garantía comprometida como garantía para su propio uso.
