Pretexto
Un pretexto es una excusa para hacer algo o decir algo que no es exacto. Los pretextos pueden basarse en una verdad a medias o desarrollarse en el contexto de una invención engañosa. Los pretextos se han utilizado para ocultar el verdadero propósito o racionalidad detrás de las acciones y las palabras. En la ley estadounidense, un pretexto suele describir razones falsas que ocultan las verdaderas intenciones o motivaciones de una acción legal. Si una parte puede establecer una presunción prima facie para la evidencia ofrecida, la parte contraria debe probar que estas razones eran "pretextuales" o falsas. Esto puede lograrse demostrando directamente que las motivaciones detrás de la presentación de la evidencia son falsas, o indirectamente por la evidencia de que las motivaciones no son "creíbles". En Griffith v. Schnitzer, un caso de discriminación en el empleo, una sentencia del jurado fue revocada por una Corte de Apelaciones porque las pruebas no eran suficientes para que las razones del acusado fueran "pretextuales". Es decir, la evidencia del acusado era indiscutible, o la del demandante era "evaluaciones subjetivas irrelevantes y opiniones".
