Criminalisation

La criminalisation ou la criminalisation, en criminologie, est «le processus par lequel les comportements et les individus se transforment en crimes et criminels». Les actes juridiques antérieurs peuvent être transformés en crimes par voie législative ou décision judiciaire. Cependant, il existe généralement une présomption formelle dans les règles de l'interprétation législative contre l'application rétrospective des lois et seul l'utilisation de mots express par le législateur peut réfuter cette présomption. Le pouvoir des juges de faire de nouvelles lois et de criminaliser rétrospectivement le comportement est également découragé. D'une manière moins évidente, où les lois n'ont pas été strictement appliquées, les actes interdits par ces lois peuvent également faire l'objet d'une criminalisation de facto par le biais d'une application légale plus efficace ou commise.
