Endangerment

Dans le droit américain, la mise en danger comprend plusieurs types de crimes impliquant des comportements illicites, imprudents ou défectueux, et susceptibles de causer la mort ou des lésions corporelles graves à une autre personne. Dans certains États, comme la Floride, une langue sensiblement similaire est utilisée pour le crime de «culpabilité négligence». L'infraction est destinée à interdire et donc à dissuader une conduite imprudente ou déloyale qui crée injustement un risque important de décès ou de blessures graves pour d'autres personnes. La loi spécifie plusieurs types de mise en danger: ▪ Empreinte d'enfant: placer un enfant dans une situation potentiellement préjudiciable, soit par négligence, soit faute d'inconduite. ▪ Mise en danger imprudente: une personne commet le crime de mise en danger imprudente si la personne s'engage témérairement dans une conduite qui crée un risque important de blessures graves pour une autre personne. La conduite «imprudente» est une conduite qui présente un mépris coupable des conséquences prévisibles pour les autres de la loi ou de l'omission impliquée. L'accusé ne doit pas intentionnellement causer un dommage résultant. In US law, endangerment comprises several types of crimes involving conduct that is wrongful and reckless or wanton, and likely to produce death or grievous bodily harm to another person. In some states, such as Florida, substantially similar language is used for the crime of "Culpable Negligence." The offense is intended to prohibit and therefore deter reckless or wanton conduct that wrongfully creates a substantial risk of death or serious injury to others. The law specifies several types of endangerment: ▪ Child endangerment: placing a child in a potentially harmful situation, either through negligence or misconduct. ▪ Reckless endangerment: A person commits the crime of reckless endangerment if the person recklessly engages in conduct which creates a substantial risk of serious physical injury to another person. “Reckless” conduct is conduct that exhibits a culpable disregard of foreseeable consequences to others from the act or omission involved. The accused need not intentionally cause a resulting harm.
