Le système judiciaire est le système des tribunaux qui interprète et applique la loi au nom de l'État. Le système judiciaire fournit également un mécanisme de règlement des différends. En vertu de la doctrine de la séparation des pouvoirs, le pouvoir judiciaire ne fait généralement pas de loi ou d'application de la loi, mais interprète plutôt le droit et l'applique aux faits de chaque affaire. Cette branche de l'État est souvent chargée d'assurer une justice égale en vertu de la loi. Il s'agit généralement d'un tribunal d'appel final, ainsi que de tribunaux inférieurs. Dans de nombreuses juridictions, le pouvoir judiciaire a le pouvoir de modifier les lois par voie de contrôle judiciaire. Les tribunaux dotés d'un pouvoir de contrôle judiciaire peuvent annuler les lois et les règles de l'État lorsqu'ils les trouvent incompatibles avec une norme plus élevée, comme la législation primaire, les dispositions de la constitution ou le droit international. Les juges constituent une force critique pour l'interprétation et la mise en œuvre d'une constitution, donc de fait dans les pays de common law créant le corps du droit constitutionnel.
