Arbitragem
A arbitragem, uma forma de resolução alternativa de disputas, é uma técnica para a resolução de litígios fora dos tribunais. As partes em uma disputa referem-se a arbitragem por uma ou mais pessoas e concordam em ficar vinculadas pela decisão arbitral. Um terceiro analisa a evidência no caso e impõe uma decisão legalmente vinculativa para ambos os lados e executória nos tribunais. Outras formas de ADR incluem mediação e resolução não vinculativa por especialistas. A arbitragem é freqüentemente usada para a resolução de disputas comerciais, particularmente no contexto de transações comerciais internacionais. Em certos países, como os Estados Unidos, a arbitragem também é freqüentemente empregada em questões de consumo e emprego, onde a arbitragem pode ser exigida pelos termos de emprego ou contratos comerciais. A arbitragem pode ser voluntária ou obrigatória e pode ser vinculativa ou não obrigatória. A arbitragem não vinculativa é semelhante à mediação na medida em que uma decisão não pode ser impostas às partes.
