Um tribunal de sucessões é um tribunal especializado que trata de assuntos de sucessão e administração de propriedades. Os tribunais de provas administram a distribuição adequada dos bens de um decedente, julgam a validade dos testamentos, cumprem as disposições de uma vontade válida, impedem a malversação por parte dos executores e administradores de propriedades e prevê a distribuição equitativa dos bens das pessoas que morrem atestadas, por exemplo, mediante a concessão de uma concessão de administração que dá aprovação judicial ao representante pessoal para administrar assuntos da propriedade. Em questões contestadas, um tribunal de sucessão examina a autenticidade de um testamento e decide quem deve receber a propriedade da pessoa falecida. Em um caso de intestacy, o tribunal determina quem deve receber a propriedade do falecido de acordo com a lei de sua jurisdição. O tribunal de sucessões supervisionará o processo de distribuição dos ativos do falecido aos beneficiários adequados. Em algumas jurisdições, esses tribunais também são chamados de tribunais órfãos, ou tribunais ordinários. A probate court is a specialized court that deals with matters of probate and the administration of estates. Probate courts administer proper distribution of the assets of a decedent, adjudicates the validity of wills, enforces the provisions of a valid will, prevents malfeasance by executors and administrators of estates, and provides for the equitable distribution of the assets of persons who die intestate, such as by granting a grant of administration giving judicial approval to the personal representative to administer matters of the estate. In contested matters, a probate court examines the authenticity of a will and decides who is to receive the deceased person's property. In a case of an intestacy, the court determines who is to receive the deceased's property under the law of its jurisdiction. The probate court will then oversee the process of distributing the deceased’s assets to the proper beneficiaries. In some jurisdictions, such courts are also referred to as orphans courts, or courts of ordinary. Not all jurisdictions have probate courts, in many places, probate functions are performed by a chancery court or another court of equity.
