O termo "estado da técnica" refere-se ao mais alto nível de desenvolvimento geral, como de um dispositivo, técnica ou campo científico alcançado em um determinado momento. Também se refere ao nível de desenvolvimento alcançado em qualquer momento específico como resultado das metodologias comuns empregadas. O termo foi usado desde 1910 e tornou-se um termo comum em publicidade e marketing e uma frase legalmente significativa em relação tanto à lei de patentes quanto à responsabilidade extracontratual. Na publicidade, a frase é freqüentemente usada para transmitir que um produto é feito com a melhor tecnologia possível, mas observou-se que "o termo" estado da arte "requer pouca prova por parte dos anunciantes", como é considerado mero puffery.
