O Usufruto é titulado para outra pessoa ou é de propriedade comum, desde que a propriedade não está danificado ou destruído. O terceiro direito de propriedade da lei romana é abusivo, o direito de alienar a coisa possuída, seja consumindo ou destruindo, ou transferindo para outra pessoa. Alguém gostando dos três direitos teria propriedade total. Em muitos sistemas de propriedade da usufrutabilidade, como o sistema tradicional do ejido no México, indivíduos ou grupos só podem adquirir o usufruto da propriedade e não título legal.
