CE ÎNSEAMNĂ CASE STATED ÎN ENGLEZĂ?
Caz declarat
Prin lege, un caz declarat este o procedură prin care o instanță sau un tribunal poate solicita unei alte instanțe un punct de drept. Există două tipuri: caz consultativ declarat și recurs în caz de caz. Un caz consultativ declarat se face la discreția unui judecător înainte de a se pronunța în fața instanței. Un recurs în funcție de cauză se face la cererea unei părți în procedură judecătorului după încheierea unei cauze. La audierea unei cauze, instanța superioară este limitată la examinarea numai a legii și este obligată să accepte declarația de fapt prezentată acesteia de către instanța inferioară. Dacă cererea este acordată, chestiunea este trimisă instanței superioare. Aceasta are de obicei forma "am fost / am fost corect la ..." și apoi aspectul specific al dreptului la care se referă recursul. În cazul în care cererea de declarare a unei cauze este respinsă, solicitantul ar putea să solicite căi de atac prin reexaminare judiciară. Înalta Curte va determina dacă legea a fost sau nu aplicată corect. Dacă recursul este admis, Înalta Curte va trimite cauza înapoi la instanța competentă a magistraților pentru a-și corecta decizia.
