Marca distinctivă a mărcii este un concept important în legislația care reglementează mărcile și mărcile de servicii. O marcă poate fi eligibilă pentru înregistrare sau poate fi înregistrată dacă îndeplinește funcția de marcă esențială și are caracter distinctiv.
