Primul amendament la Constituția Statelor Unite interzice luarea oricărei legi care să respecte o instituție religioasă, care împiedică exercitarea liberă a religiei, reducerea libertății de exprimare, încălcarea libertății presei, interferența cu dreptul de a se asocia sau de a interzice în mod pașnic cererea de despăgubire guvernamentală a plângerilor. A fost adoptată la 15 decembrie 1791 ca fiind unul dintre cele zece amendamente care constituie Legea drepturilor. Proiectul de lege a fost inițial propus ca o măsură pentru a atenua opoziția anti-federalistă față de ratificarea constituțională. Inițial, primul amendament sa aplicat numai legilor adoptate de Congres și multe dintre dispozițiile sale au fost interpretate mai restrâns decât sunt astăzi. Începând cu cauza Gitlow v. New York, Curtea Supremă a aplicat primul amendament statelor - un proces cunoscut sub numele de încorporare - prin clauza de procedură datorată amendamentului al paisprezecelea. În Everson v. Board of Education, Curtea a îndreptat corespondența părintelui fondator Thomas Jefferson să cheme "un zid de separare între biserică și stat", deși granița exactă a acestei separări rămâne în litigiu.
