Justiz
Die Justiz ist das System der Gerichte, die das Gesetz im Namen des Staates interpretiert und anwendet. Die Justiz stellt auch einen Mechanismus für die Beilegung von Streitigkeiten zur Verfügung. Unter der Lehre von der Trennung der Mächte macht die Justiz in der Regel kein Gesetz oder erzwingt das Gesetz, sondern interpretiert das Gesetz und wendet sie auf die Tatsachen der einzelnen Fälle an. Gerichte mit gerichtlicher Prüfungsbefugnis können die Gesetze und Regeln des Staates aufheben, wenn sie sie mit einer höheren Norm, wie dem Primärgesetz, den Bestimmungen der Verfassung oder dem Völkerrecht unvereinbar finden. Richter stellen eine kritische Kraft für die Auslegung und Umsetzung einer Verfassung dar, also de facto in den Gemeinsamen Ländern, die den Aufbau des Verfassungsrechts schaffen.
