A form of the offense is defined as an intention in criminal law. In principle, the factual principle always consists of a knowledge element and an will element. With the intention of the Willense element, the focus is on the perpetrator: it is precisely the culprit that makes a success in the sense of the offense. He acts with a purposeful success. It is not a matter of whether the perpetrator assumes that the success will surely happen. In the StGB, the term intention is often replaced by a wording with "um zu". The intention as a form of pre-emption is to be distinguished from the specific intentions mentioned in some provisions of the Criminal Code. The special intentions include the intention to take over the company in § 242 StGB and the prospect of enrichment in § 263 StGB. Here, too, the perpetrator of the offender's decision to commit a crime is important. The specific intentions, however, are independent subjective facts which must be present independently of the precautionary principle. Als Absicht wird im Strafrecht eine Form des Tatbestandsvorsatzes bezeichnet. Grundsätzlich besteht der Tatbestandsvorsatz immer aus einem Wissenselement und einem Willenselement. Bei der Absicht steht das Willenselement im Vordergrund: dem Täter kommt es gerade darauf an, einen Erfolg im Sinne des Tatbestandes herbeizuführen. Er handelt mit einem zielgerichteten Erfolgswillen. Dabei kommt es nicht darauf an, ob der Täter davon ausgeht, dass der Erfolg sicher eintritt. Im StGB wird der Begriff Absicht häufig durch eine Formulierung mit „um zu“ ersetzt. Die Absicht als Vorsatzform ist von den besonderen Absichten, die in einigen Vorschriften des Strafgesetzbuches genannt werden, zu unterscheiden. Zu den besonderen Absichten zählen die Zueignungsabsicht in § 242 StGB und die Bereicherungsabsicht in § 263 StGB. Auch hier kommt es auf die Zielvorstellung des Täters bei der Begehung einer Tat an. Die besonderen Absichten sind jedoch eigenständige subjektive Tatbestandsmerkmale, die unabhängig vom Tatbestandsvorsatz vorliegen müssen.
