Hudud

Hudud is an Islamic concept based on the Quran and Hadith that defines "crime against Allah". Among them are zina crime, mum, homosexuality, qazaf, apostasy, khamar consumption, bughat, collusion and theft. In Islamic law ie sharia, criminal law invites a series of sentences imposed by Allah according to Muslim beliefs, among them a stroke or a mortgage to death in public, a hand cut or a sentence of death in public. But penalties and killings in public are rarely seen today in most Islamic countries. Now it is found in Islamic countries which according to the strictest sharia interpretations such as Saudi Arabia and Iran. Syariah law recognizes other crimes that do not belong to hudud. Among them is a qisas which is considered as a personal dispute between the two parties which allows retaliation as punishment, and the taxable penalty which is up to the discretion of the Syariah judge. Hudud merupakan konsep Islam yang berasaskan al-Quran dan Hadis yang menakrifkan "jenayah terhadap Allah". Antaranya adalah jenayah zina, mukah, kehomoseksualan, qazaf, murtad, pengambilan khamar, bughat, penyamunan dan pencurian. Dalam hukum Islam iaitu syariah, jenayah hukum mengundang segolongan hukuman yang ditetapkan oleh Allah menurut kepercayaan Muslim, antaranya sebatan atau rejaman hingga mati di khalayak umum, pemotongan tangan atau hukuman bunuh di khalayak umum. Akan tetapi hukuman rejam dan bunuh di khalayak umum agak jarang berlaku pada zaman sekarang di kebanyakan negara Islam. Kini ia terdapat di negara-negara Islam yang menurut tafsiran syariah yang paling ketat seperti Arab Saudi dan Iran. Hukum syariah mengenali jenayah-jenayah lain yang tidak tergolong dalam hudud. Antaranya ialah qisas yang dikira sebagai pertikaian peribadi antara dua pihak yang membenarkan tindakan balas sebagai hukuman, dan takzir yang mana hukuman terpulang kepada budi bicara hakim syariah.
