Penalización

La criminalización o criminalización, en la criminología, es "el proceso por el cual los comportamientos y los individuos se transforman en crimen y criminales". Anteriormente, los actos jurídicos pueden transformarse en delitos mediante legislación o decisión judicial. Sin embargo, suele haber una presunción formal en las reglas de interpretación legal contra la aplicación retrospectiva de las leyes y sólo el uso de palabras expresas por el legislador puede refutar esta presunción. También se desaconseja el poder de los jueces para hacer nuevas leyes y criminalizar de manera retroactiva el comportamiento. De una manera menos abierta, donde las leyes no se han aplicado estrictamente, los actos prohibidos por esas leyes también pueden someterse a la criminalización de facto a través de una aplicación legal más efectiva o comprometida.
