Caractère distinctif des marques
Le caractère distinctif des marques est un concept important dans la loi régissant les marques de commerce et les marques de service. Une marque peut être admissible à l'inscription, ou enregistrable, si elle remplit la fonction de marque essentielle et possède un caractère distinctif. L'enregistrement peut être compris comme un continuum, avec des marques «intrinsèquement distinctives» à une extrémité, des marques «génériques» et «descriptives» sans caractère distinctif à l'autre extrémité, et des marques «suggestives» et «arbitraires» situées entre ces deux points. Les marques «descriptives» doivent acquérir le caractère distinctif par un sens secondaire: les consommateurs ont reconnu la marque comme un indicateur source - pour être protégés. Les termes "génériques" sont utilisés pour désigner le produit ou le service lui-même et ne peuvent être utilisés comme marques commerciales.
