Distinguishing

En droit, la distinction entre un cas signifie qu'un tribunal décide que l'exploitation ou le raisonnement juridique d'un cas précédent ne s'appliquera pas en raison de faits matériellement différents entre les deux affaires. Il y a deux contraintes formelles sur le tribunal postérieur: les facteurs dans le rapport du cas antérieur doivent être conservés dans la formulation du rapport de l'affaire plus tard, et la décision dans le dernier cas doit encore soutenir le résultat obtenu dans le cas précédent. La décision rendue par le juge doit reposer non seulement sur les éléments de preuve auxquels ils sont confrontés, mais aussi sur les précédents dans lesquels ils doivent suivre. Cela signifie qu'un précédent sera traité dans un cas avec des faits similaires, dans lesquels une décision peut ensuite être distinguée en fonction de cela. In law, to distinguish a case means a court decides the holding or legal reasoning of a precedent case will not apply due to materially different facts between the two cases. There are two formal constraints on the later court: the factors in the ratio of the earlier case must be retained in formulating the ratio of the later case, and the ruling in the later case must still support the result reached in the precedent case. The ruling made by the judge must be based around not only the evidence they are faced with, but the precedents in which they must follow. This means that a precedent will be dealt to a case with similar facts, in which a decision can then be distinguished based upon this.
