Mariage putatif
Un mariage putatif est un mariage apparemment valide, conclu de bonne foi par un ou plusieurs partenaires, mais cela est juridiquement invalide en raison d'un empêchement technique, tel qu'un mariage pré-existant de la part d'un des partenaires. Contrairement à quelqu'un dans un mariage en union libre, statutaire ou cérémonielle, un conjoint putatif n'est pas légalement marié. Au lieu de cela, un conjoint putatif se croit marié de bonne foi et bénéficie de droits légaux en raison de la confiance de cette personne à l'égard de cette croyance de bonne foi. Des mariages putatifs existent dans le droit canonique catholique et dans diverses lois civiles, bien que les règles puissent varier. Dans certaines juridictions, les mariages putatifs sont une question de jurisprudence plutôt que de législation. Dans de nombreuses juridictions, en vertu du droit civil, le mariage devient valable si l'empêchement est supprimé. Si elle n'est pas retirée, le conjoint innocent, au moins, a souvent droit à la protection d'un divorce pour la division des biens et la garde des enfants.
