Réfutation
En droit, la réfutation est une forme de preuve qui est présentée pour contredire ou annuler d'autres preuves qui ont été présentées par une partie adverse. Par analogie, le même terme est utilisé dans la politique et les affaires publiques pour se référer au processus informel par lequel les déclarations, conçues pour réfuter ou nier les arguments spécifiques avancés par les adversaires, sont déployées dans les médias. En droit, des règles spéciales s'appliquent à la réfutation. La preuve de réfutation ou les témoins de réfutation ne doivent se limiter qu'à l'objet de la preuve refutée. De nouveaux éléments de preuve sur d'autres sujets peuvent ne pas être réfutés. Toutefois, la réfutation est l'un des rares véhicules par lesquels une partie peut présenter des preuves ou des témoins étonnants. Le processus de base est le suivant: Les deux côtés d'une controverse sont obligés de déclarer avant le procès quels témoins ils ont l'intention d'appeler, et ce à quoi chaque témoin devrait témoigner. Lorsque un demandeur ou un défendeur apporte une preuve directe ou un témoignage qui n'était pas prévu, l'autre partie peut se voir accorder une occasion spécifique de le réfuter.
