Récrimination

Recrimination

En droit, la récrimination est une défense dans une action en divorce dans laquelle l'accusé fait une accusation similaire contre le demandeur. En anglais simple, c'est la façon d'un avocat de dire "Toi aussi". La récrimination a généralement été considérée par les experts en droit de la famille comme l'un des aspects les plus dysfonctionnels et illogiques de l'ancien système de divorce basé sur les fautes dans les pays de common law. Par exemple, dans le contexte d'un mariage où la relation conjugale s'est effondrée au point que les deux conjoints commettent ouvertement l'adultère, l'affirmation par l'un ou l'autre des conjoints de cette défense empêcherait le divorce même si l'unité familiale n'est manifestement plus capable de fonctionner . En conséquence, la défense a été formellement abolie par la loi dans plusieurs juridictions lorsqu'elles se sont transformées en régime de divorce sans faute. Le principe corollaire de la rectitude comparative a amélioré les effets de la doctrine de la récrimination en considérant que, si les infractions étaient entièrement différentes, le conjoint coupable de la faute mineure avait toujours droit à réparation. In law, recrimination is a defense in an action for divorce in which the accused party makes a similar accusation against the plaintiff. In plain English, it is a lawyer's way of saying, "You too." Recrimination was generally considered by family law experts to be one of the most dysfunctional and illogical aspects of the old fault-based divorce system in common law countries. For example, in the context of a marriage where the marital relationship has collapsed to the point that both spouses are openly committing adultery, the assertion by either spouse of this defense would prevent a divorce even though the family unit is clearly no longer capable of functioning. As a result, the defense was formally abolished by statute in many jurisdictions when they converted to a no-fault divorce regime. The corollary principle of comparative rectitude ameliorated the effects of the recrimination doctrine by holding that if the offenses were of entirely different orders of seriousness, the spouse guilty of the lesser fault was still entitled to relief.
