Parere concorrente

In linea di principio, un parere concorrente è un parere scritto da uno o più giudici di un tribunale che concorda con la decisione della maggioranza del tribunale, ma afferma diverse ragioni come la base della sua decisione. Quando la maggioranza assoluta del tribunale non può concordare sulla base della decisione del giudizio, la decisione del giudice può essere contenuta in una serie di pareri concorrenti e il parere concorrente congiunto dal maggior numero di giudici è denominato parere pluralista . Come pratica, i pareri concorrenti sono leggermente meno utili per gli avvocati che le opinioni di maggioranza. Non avendo ricevuto la maggioranza dei voti della corte, i pareri concorrenti non sono vincolanti e non possono essere citati in quanto tali. Ma alcuni concorrenti pareri possono talvolta essere citati come una forma di precedente persuasivo. Il conflitto di opinioni tra un parere di maggioranza e un parere concorrente può aiutare un avvocato a comprendere i punti di legge articolati nell'opinione di maggioranza.
