Nel diritto comune i sistemi giuridici, un precedente o un'autorità è un principio o una regola stabilito in un precedente caso giuridico che sia vincolante o convincente per un tribunale o un altro tribunale quando decida i casi successivi con emissioni o fatti simili. Il principio generale dei sistemi giuridici comuni è che si debba decidere casi simili in modo da dare risultati simili e prevedibili, e il principio del precedente è il meccanismo attraverso il quale tale obiettivo è raggiunto. Il Dizionario di legge del nero definisce "precedente" come "regola di diritto stabilita per la prima volta da un tribunale per un particolare tipo di caso e successivamente riferito a decidere casi simili". Il precedente diritto comune è un terzo tipo di legge, a parità di diritto legale e diritto normativo. Stare decisis è un principio giuridico attraverso il quale i giudici sono tenuti a rispettare il precedente stabilito da decisioni precedenti.
