Res judicata o res iudicata, nota anche come preclusione di reclamo, è il termine latino per "una questione giudicata" e può fare riferimento a due concetti: sia nel diritto civile che nel diritto comune, un caso in cui è stata pronunciata una sentenza definitiva E non è più oggetto di ricorso; E la dottrina giuridica intesa a ostacolare la continua controversia di tali casi tra le stesse parti, diversa tra i due ordinamenti giuridici. In quest'ultimo utilizzo, il termine è sinonimo di "preclusione". In caso di res judicata, la questione non può essere sollevata nuovamente, nello stesso giudice o in un altro tribunale. Un tribunale utilizzerà res judicata per negare la riconsiderazione di una questione. Il concetto giuridico di res judicata nasce come un metodo per impedire l'ingiustizia alle parti di un caso presunto finito, ma forse per lo più per evitare sprechi inutili di risorse nel sistema giudiziario. Il res judicata non si limita ad impedire che i futuri giudizi contraddicono le precedenti, ma impedisce anche ai ricorrenti di moltiplicare i giudizi, in modo che un attore prevalente non possa recuperare i danni dalla convenuta due volte per lo stesso infortunio.

Res judicata or res iudicata, also known as claim preclusion, is the Latin term for "a matter judged", and may refer to two concepts: in both civil law and common law legal systems, a case in which there has been a final judgment and is no longer subject to appeal; and the legal doctrine meant to bar continued litigation of such cases between the same parties, which is different between the two legal systems. In this latter usage, the term is synonymous with "preclusion". In the case of res judicata, the matter cannot be raised again, either in the same court or in a different court. A court will use res judicata to deny reconsideration of a matter. The legal concept of res judicata arose as a method of preventing injustice to the parties of a case supposedly finished, but perhaps mostly to avoid unnecessary waste of resources in the court system. Res judicata does not merely prevent future judgments from contradicting earlier ones, but also prevents litigants from multiplying judgments, so a prevailing plaintiff could not recover damages from the defendant twice for the same injury.
