法律では、事件を区別するために、裁判所が、2件の事実の間に事実上異なる事実があるため、前例の保有または法的理由が当てはまらないと判断することを意味する。 後の裁判所には2つの正式な制約があります:前者の割合の要素は、後者の割合を定式化する際に保持されなければならず、後の場合の判決は、前例の場合に達成された結果を支持しなければなりません。 裁判官によってなされた判決は、直面している証拠だけでなく、従わなければならない先例にも基づいていなければならない。 これは、事実が類似している事例に先例が与えられ、その事実に基づいて判断が区別されることを意味する。
