O direito público é aquela parte da lei que rege as relações entre os indivíduos e o governo, e as relações entre indivíduos que são de interesse direto para a sociedade. O direito público compreende direito constitucional, direito administrativo, direito tributário e direito penal, bem como todo direito processual. No direito público, as regras imperativas prevalecem. As leis relativas às relações entre indivíduos pertencem ao direito privado. As relações que o direito público governa são assimétricas e desiguais - os órgãos governamentais podem tomar decisões sobre os direitos dos indivíduos. No entanto, como conseqüência da doutrina da lei, as autoridades só podem atuar dentro da lei. O governo deve obedecer a lei. Por exemplo, um cidadão insatisfeito com uma decisão de uma autoridade administrativa pode pedir um tribunal para revisão judicial. Os direitos, também, podem ser divididos em direitos privados e direitos públicos. Um paradigma de direito público é o direito a benefícios de assistência social - apenas uma pessoa física pode reivindicar tais pagamentos, e eles são premiados através de uma decisão administrativa fora do orçamento do governo. A distinção entre direito público e direito privado remonta ao direito romano.

Public law is that part of law which governs relationships between individuals and the government, and those relationships between individuals which are of direct concern to the society. Public law comprises constitutional law, administrative law, tax law and criminal law, as well as all procedural law. In public law, mandatory rules prevail. Laws concerning relationships between individuals belong to private law. The relationships public law governs are asymmetric and unequal – government bodies can make decisions about the rights of individuals. However, as a consequence of the rule of law doctrine, authorities may only act within the law. The government must obey the law. For example, a citizen unhappy with a decision of an administrative authority can ask a court for judicial review. Rights, too, can be divided into private rights and public rights. A paragon of a public right is the right to welfare benefits – only a natural person can claim such payments, and they are awarded through an administrative decision out of the government budget. The distinction between public law and private law dates back to Roman law.
