Independentemente da terminologia, todas essas formas de acordos são, de acordo com o direito internacional, igualmente considerados tratados e as regras são as mesmas. Os tratados podem ser vagamente comparados aos contratos: ambos são meios de partidos dispostos assumindo obrigações entre si, e uma parte que não cumpre suas obrigações pode ser responsabilizada pelo direito internacional.
