Uneori, clauzele de separabilitate vor preciza că anumite prevederi ale contractului sunt atât de importante pentru scopul contractului încât, dacă acestea sunt ilegale sau inaplicabile, contractul în ansamblul său va fi anulat. Cu toate acestea, în multe jurisdicții juridice, nu se va aplica o clauză de separabilitate dacă modifică natura fundamentală a contractului și, în schimb, contractul va fi nul; astfel, adesea acest lucru nu este explicit menționat în clauza de separabilitate.
