विशेष— यह हींदू धर्मशास्त्र के प्रधान विषयों में से है । मनु,
याज्ञवल्क्य आदि स्मृतियों में इसके संबंध में विस्तृत व्यवस्था है । ग्रंथकारों और टीकाकारों के मतभेद से पैतृक धनविभाग के संबंध में भिन्न भिन्न स्थानों में भिन्न भिन्न व्यवस्थाएँ प्रच-
लित हैं । प्रधान पक्ष दो हैं—मिताक्षरा और दायभाग ।
मिताक्षरा याज्ञवल्क्य स्मृति पर विज्ञानेश्वर की टीका है जिसके
अनुकूल व्यवस्था पंजाब, काशी, मिथिला आदि से लेकर
दक्षिण कन्याकुमारी तक प्रचलति है । 'दायभाग' जीमूत-
वाहन का एक ग्रंथ है जिसका प्रचार वंग देश में है ।
सबसे पहली बात विचार करने की यह है कि कुटुंबसंपत्ति में
किसी प्राणी का पृथक् स्वत्व विभाग करने के पीछे होता है
अथवा पहले से रहता है । मिताक्षरा के अनुसार विभाग होने
पर ही पृथक् या एकदेशीय स्वत्व होता है, विभाग के पहले
सारी कुटुंबसंपत्ति पर प्रत्येक संमिलित प्राणी का सामान्य
स्वत्व रहता है । दायभाग विभाग के पहले भी अव्यक्त रूप
में पृथक् स्वत्व मानता है जो विभाग होने पर व्यंजित होता है । मिताक्षरा पूर्वजों की संपत्ति में पिता और पुत्र का समा-
नाधिकार मानती है अतः पुत्र पिता के जीते हुए भी जब चाहे
पैतृक संपत्ति में हिस्सा बँटा सकते हैं और पिता पुत्रों की
सम्मति के बिना पैतृक संपत्ति के किसी अंश का दान, विक्रय
आदि नहीं कर सकता । पिता के मरने पर पुत्र जो पैतृक
संपत्ति का अधिकारी होता है वह हिस्सेदार के रूप में हाता
है, उत्तराधिकारी के रूप में नहीं । मिताक्षरा पुत्र का उत्त-
राधिकार केवल पिता की निज की पैदा की हुई संपत्ति में
मानती है । दायभाग पूर्वपस्वामी के स्वत्वविनाश (मृत, पतित
या संन्यासी होने के कारण) के उपरांत उत्तराधिकारियों के
स्वत्व की उत्पत्ति मानता है । उसके अनुसार जब तक पीता
जीवित है तब तक पैतृक संपत्ति पर उसका पूर अधिकार है;
वह उसे जो चाहे सो कर सकता है । पुत्रों के स्वत्व की उत्पत्ति
पिता के मरने आदि पर ही होती है ।
यद्यपि याज्ञवल्क्य के इस श्लोक में 'भूर्या पितामहोपात्ता' निबंधी
द्रव्यमेव वा । तत्र स्यात् सदृशं स्वाम्यं पितुः पुत्रस्य चोभचोः
पिता पुत्र का समान अधिकार स्पष्ट कहा गया है तथापि जीमूतवाहन
ने इस श्लोक से खींच तानकर यह भाव निकाला है
कि पुत्रों के स्वत्व की उत्पत्ति उनके जन्मकाल से नहीं, वल्कि
पिता के मृत्युकाल से होती है ।
मिताक्षरा और दायभाग के अनुसार जिस क्रम से उत्तराधिकारी
होते हैं वह नीचे दिया जाता हैः
