Af

Amnesty, in general, means the forgiveness of someone's fault. There are rules about how to treat all societies, starting from the family, at school and in society. Acting against this rule is considered a crime or a misdemeanor. However, a father can forgive some irregular behavior of a child, a teacher student. In the case of amnesty in the law, the state has to donate the criminal offenders in some cases. In this case, the amnesty is a punishment given to a court, or even a direct crime to be ignored. Amnesty is divided into general amnesty and special amnesty. It is a specific offense and an affa general amnesty which removes the punishment of those convicted of this crime. The record of the prosecution in the prosecutor's office is deleted and the person is deemed to have never been convicted. It may be unfair and misjudged in a judgment. Amnesty is also called special amnesty for the correction of such unjust and wrong decisions and the forgiveness of elderly or sickly prisoners. Special amnesty only alleviates the application of punishment or removes it altogether.

Af, genel anlamda, bir kişinin kusurunun bağışlanması demektir. Bütün toplumların aileden başlayarak, okulda ve toplum içinde nasıl davranılacağına ilişkin kuralları vardır. Bu kurallara aykırı hareket etmek suç ya da kabahat olarak kabul edilir. Bununla birlikte bir baba çocuğunun, bir öğretmen öğrencisinin bazı kuraldışı davranışlarını bağışlayabilir. Hukukta af ise, devletin suç işleyip hüküm giymiş bireyleri bazı durumlarda bağışlamasıdır. Bu durumda af, bir mahkemece verilmiş cezanın, hatta doğrudan doğruya suçun yok sayılmasıdır. Af, genel af ve özel af olmak üzere ikiye ayrılır. Belirli bir suçu ve bu suçtan hüküm giymiş kişilerin cezalarını ortadan kaldıran affa genel af denir. Aftan yararlanan kişinin savcılıktaki sabıka kaydı silinir ve o kişi hiç hüküm giymemiş sayılır. Bir yargılamada adaletsiz ve yanlış karar verilmiş olabilir. Bu tür adaletsiz ve yanlış kararların düzeltilmesi, yaşlı ya da hasta hükümlülerin bağışlanması için çıkarılan affa da özel af denir. Özel af ya yalnızca cezanın uygulanmasını hafifletir ya da tamamen ortadan kaldırır.
