En los sistemas jurídicos de derecho consuetudinario, un precedente o autoridad es un principio o regla establecido en un caso legal anterior que es vinculante o persuasivo para un tribunal u otro tribunal al decidir casos posteriores con asuntos o hechos similares. El principio general en los sistemas legales de derecho consuetudinario es que los casos similares deben ser decididos para dar resultados similares y predecibles, y el principio de precedente es el mecanismo por el cual se alcanza ese objetivo. Black's Law Dictionary define el "precedente" como una "regla de derecho establecida por primera vez por un tribunal para un determinado tipo de caso y posteriormente se hace referencia en la decisión de casos similares".
