Principe de légalité
Le principe de légalité est l'idéal juridique qui exige que toute loi soit claire, vérifiable et non rétrospective. Elle exige que les décideurs décident de résoudre les différends en appliquant des règles juridiques préalablement déclarées et pour ne pas modifier la situation juridique rétrospectivement par dérogation discrétionnaire à la loi établie. Il est étroitement lié au formalisme légal et à la règle de droit et peut être découlé des écrits de Feuerbach, Dicey et Montesquieu. Le principe revêt une importance particulière dans le droit pénal et administratif. En droit pénal, on peut constater l'interdiction générale d'imposer des sanctions pénales pour des actes ou des omissions qui n'étaient pas criminels au moment de leur commission ou de leur omission. Le principe est également considéré comme violé lorsque les sanctions pour un crime particulier sont augmentées avec effet rétrospectif. Dans le droit administratif, on peut voir dans le désir que les fonctionnaires de l'État soient liés par la loi plutôt que d'agir sur le caprice. En tant que tels, les défenseurs du principe sont normalement contre des pouvoirs discrétionnaires.
