Une hypothèque est une sûreté sur les biens immobiliers détenue par un prêteur comme caution pour une dette, généralement un prêt d'argent. Une hypothèque en soi n'est pas une dette, c'est la garantie du prêteur pour une dette. Il s'agit d'un transfert d'un intérêt sur le terrain du propriétaire au prêteur hypothécaire, à condition que cet intérêt soit retourné au propriétaire lorsque les conditions de l'hypothèque ont été satisfaites ou exécutées. En d'autres termes, l'hypothèque est une garantie pour le prêt que le prêteur fait à l'emprunteur. Le mot est un terme de loi en français qui signifie «gage mort», à l'origine se référant uniquement à l'hypothèque gallois, mais au dernier Moyen Âge a été appliqué à tous les jalons et réinterprété par l'étymologie populaire pour signifier que l'engagement prend fin soit lorsque l'obligation est remplie La propriété est effectuée par forclusion. Dans la plupart des juridictions, les prêts hypothécaires sont fortement associés à des prêts garantis sur des biens immobiliers plutôt qu'à d'autres biens et, dans certaines juridictions, seules les terres peuvent être hypothéquées. Une hypothèque est la méthode standard par laquelle les particuliers et les entreprises peuvent acheter des biens immobiliers sans avoir à payer la pleine valeur immédiatement de leurs propres ressources.
