Un pretesto è una scusa per fare qualcosa o dire qualcosa che non è preciso. I pretesti possono essere basati su una mezza verità o sviluppati nel contesto di una fabbricazione fuorviante. I pretesti sono stati utilizzati per nascondere il vero scopo o la ragione dietro le azioni e le parole. Nella legge americana, un pretesto descrive solitamente le ragioni false che nascondono le vere intenzioni o motivazioni per un'azione legale. Se una parte può stabilire un caso prima facie per le prove offerte, la parte avversaria deve dimostrare che queste ragioni erano "pretextual" o false. Ciò può essere realizzato dimostrando direttamente che le motivazioni alla base della presentazione delle prove sono false, o indirettamente, per dimostrazione che le motivazioni non sono "credibili". A Griffith v. Schnitzer, un caso di discriminazione in materia di occupazione, un appello di giuria è stato invertito da una Corte d'appello perché le prove non erano sufficienti che le ragioni del convenuto erano "pretextual". Ciò significa che la prova del convenuto era indiscussa o che il ricorrente era "valutazioni e opinioni soggettive irrilevanti".
