Na tradição de direito comum, uma absolvição certifica formalmente que o acusado é livre da acusação de uma ofensa, no que diz respeito ao direito penal. Isto é mesmo quando a promotoria é abandonada nolle prosequi. A finalidade de uma absolvição depende da jurisdição. Em alguns países, como os Estados Unidos, de acordo com as regras de dupla ameaça e outrafois acquit, uma absolvição opera para impedir o julgamento do acusado pela mesma infração, mesmo que novas evidências abranquem o que implica ainda o acusado. O efeito de uma absolvição no processo penal é o mesmo, quer resulte de um veredicto do júri, ou se resulta da operação de alguma outra regra que descarrega o acusado. Em outros países, a autoridade promotora pode recorrer de uma absolvição semelhante à de como um requerido pode recorrer de uma condenação.

This is so even where the prosecution is abandoned nolle prosequi. The finality of an acquittal is dependent on the jurisdiction. In some countries, such as the United States, under the rules of double jeopardy and autrefois acquit, an acquittal operates to bar the retrial of the accused for the same offense, even if new evidence surfaces that further implicates the accused. The effect of an acquittal on criminal proceedings is the same whether it results from a jury verdict, or whether it results from the operation of some other rule that discharges the accused. In other countries, the prosecuting authority may appeal an acquittal similar to how a defendant may appeal a conviction.
