Dreptul de a păstra și a purta arme este dreptul poporului de a avea propriile sale arme pentru apărarea lor, așa cum este descris în scrierile filosofice și politice ale lui Aristotle, Cicero, John Locke, Machiavelli, Whigs și altele. În țările cu o tradiție engleză obișnuită, dreptul comun de lungă durată de a păstra și de a purta arme a fost mult timp recunoscut, ca preexistent în dreptul comun, înainte de existența unor constituții naționale scrise. În Statele Unite, dreptul de a păstra și de a purta arme este, de asemenea, un drept enumerat protejat în mod specific de Constituția Statelor Unite și multe constituții ale statului, astfel încât oamenii au un drept personal de a deține arme pentru uz individual și un drept de a purta aceleași arme pentru protecția personală și pentru folosirea într-o miliție.
