Freiwilligkeit ist ein rechtliches und philosophisches Konzept, das sich auf eine Wahl bezieht, die aus dem freien Willen einer Person gemacht wird, im Gegensatz zu Sein als Folge von Zwang oder Zwang gemacht. Die tatsächliche Freiwilligkeit ist verdächtig, da es üblich ist, dass die Staatsanwälte drohen, mehr Gefängniszeit zu suchen, es sei denn, der Angeklagte stimmt zu, schuldig zu plädieren. Aus diesem Grund haben die Common Law Courts historisch einen negativen Blick auf schuldige Klagegründe genommen.
